Our field guide to birds says this is a 'Darter', the difference being the darter has a long slender neck and sharp bill. It spears fish underwater by straightening the neck, then comes to the surface to eat them.

I like the old dead snag with the kites in it's branches. The diagonal flow through the picture is nice also. I wish though that the lighting had not been quite so harsh. This same picture at dusk or dawn would be awesome.
